国君抚式,大夫下之。大夫抚式,士下之。礼不下庶人,刑不上大夫。刑人不在君侧。
Qu Li I:
Where the ruler of a state lays hold of the cross-bar, and bends forward to it, a great officer will descend from his carriage. Where a great officer lays bold of the bar and bends forward, another officer will descend. The rules of ceremony do not go down to the common people. The penal statutes do not go up to great officers. Men who have suffered punishment should not (be allowed to) be by the side of the ruler.

夫倮虫三百六十,人为之长。人、物也,万物之中有知慧者也。其受命于天,禀气于元,与物无异。鸟有巢栖,兽有窟穴,虫鱼介鳞,各有区处,犹人之有室宅楼台也。能行之物,死伤病困,小大相害。或人捕取,以给口腹,非作窠穿穴有所触,东西行徙有所犯也。人有死生,物亦有终始;人有起居,物亦有动作。血脉、首足、耳目、鼻口与人不别,惟好恶与人不同,故人不能晓其音,不见其指耳!及其游于党类,接于同品,其知去就,与人无异。共天同地,并仰日月,而鬼神之祸,独加于人,不加于物,未晓其故也。天地之性、人为贵,岂天祸为贵者作,不为贱者设哉?何其性类同而祸患别也?“刑不上大夫”,圣王于贵者阔也。圣王刑贱不罚贵,鬼神祸贵不殃贱,非《易》所谓“大人与鬼神合其吉凶”也。

事未易一二为俗人言也。仆之先人非有剖符丹书之功,文史星历近乎卜祝之间,固主上所戏弄,倡优畜之,流俗之所轻也。假令仆伏法受诛,若九牛亡一毛,与蝼蚁何异?而世又不与能死节者比,特以为智穷罪极,不能自免,卒就死耳。何也?素所自树立使然。人固有一死,死有重于泰山,或轻于鸿毛,用之所趋异也。太上不辱先,其次不辱身,其次不辱理色,其次不辱辞令,其次诎体受辱,其次易服受辱,其次关木索被棰楚受辱,其次鬄毛发婴金铁受辱,其次毁肌肤断支体受辱,最下腐刑,极矣。传曰“刑不上大夫”,此言士节不可不厉也。猛虎处深山,百兽震恐,及其在阱槛之中,摇尾而求食,积威约之渐也。故士有画地为牢势不入,削木为吏议不对,定计于鲜也。今交手足,受木索,暴肌肤,受榜棰,幽于圜墙之中,当此之时,见狱吏则头枪地,视徒隶则心惕息。何者?积威约之势也。及已至此,言不辱者,所谓强颜耳,曷足贵乎!且西伯,伯也,拘牖里;李斯,相也,具五刑;淮阴,王也,受械于陈;彭越、张敖南乡称孤,系狱具罪;绛侯诛诸吕,权倾五伯,囚于请室;魏其,大将也,衣赭关三木;季布为朱家钳奴;灌夫受辱居室。此人皆身至王侯将相,声闻邻国,及罪至罔加,不能引决自财。在尘埃之中,古今一体,安在其不辱也!由此言之,勇怯,势也;强弱,形也。审矣,曷足怪乎!且人不能蚤自财绳墨之外,已稍陵夷至于鞭棰之间,乃欲引节,斯不亦远乎!古人所以重施刑于大夫者,殆为此也。夫人情莫不贪生恶死,念亲戚,顾妻子,至激于义理者不然,乃有不得已也。今仆不幸,蚤失二亲,无兄弟之亲,独身孤立,少卿视仆于妻子何如哉?且勇者不必死节,怯夫慕义,何处不勉焉!仆虽怯耎欲苟活,亦颇识去就之分矣,何至自湛溺累绁之辱哉!且夫臧获婢妾犹能引决,况若仆之不得已乎!所以隐忍苟活,函粪土之中而不辞者,恨私心有所不尽,鄙没世而文采不表于后也。
