47 王制:
凡制五刑,必即天論。郵罰麗於事。凡聽五刑之訟,必原父子之親、立君臣之義以權之。意論輕重之序、慎測淺深之量以別之。悉其聰明、致其忠愛以盡之。疑獄,泛與眾共之;眾疑,赦之。必察小大之比以成之。
Wang Zhi:
In all determining on the application of any of the five punishments, it was required to decide according to the judgment of Heaven. Inadvertent and redeemable offences were determined by (the circumstances of) each particular case. When hearing a case requiring the application of any of the five punishments, (the judge) was required to have respect to the affection between father and son, or the righteousness between ruler and minister (which might have been in the mind of the defendant), to balance his own judgment. He must consider the gravity or lightness (of the offence), and carefully try to fathom the capacity (of the offender) as shallow or deep, to determine the exact character (of his guilt). He must exert his intelligence to the utmost, and give the fullest play to his generous and loving feeling, to arrive at his final judgment, If the criminal charge appeared to him doubtful, he was to take the multitude into consultation with him; and if they also doubted, he was to pardon the defendant. At the same time he was to examine analogous cases, great and small, and then give his decision.

仲弓問於孔子曰:「雍問至刑無所用政,至政無所用刑。至刑無所用政,桀、紂之世是也;至政無所用刑,成、康之世是也。信乎?」孔子曰:「聖人之治化也,必刑政相參焉。太上以德教民,而以禮齊之。其次以政言導民,以刑禁之,刑不刑也。化之弗變,導之弗從,傷義以敗俗,於是乎用刑矣。顓五刑必即天倫,行刑罰則輕無赦。刑、侀也;侀、成也。壹成而不可更,故君子盡心焉。」仲弓曰:「古之聽訟,尤罰麗於事,不以其心,可得聞乎?」孔子曰:「凡聽五刑之訟,必原父子之情,立君臣之義以權之;意論輕重之序,慎深淺之量以別之;悉其聰明,正其忠愛以盡。大司寇正刑明辟以察獄,獄必三訊焉。有旨無簡,則不聽也。附從輕,赦從重,疑獄則泛與眾共之,疑則赦之,皆以小大之比成之。是故爵人必於朝,與眾共之也;刑人必於市,與眾棄之也。古者公家不畜刑人,大夫弗養其。士遇之塗,弗與之言,屏諸四方,唯其所之,弗及與政,弗欲生之也。」仲弓曰:「聽獄,獄之成成何官?」孔子曰:「成獄於吏,吏以獄之成告於正;正既聽之,乃告大司寇;大司寇聽之,乃奉於王;王命三公卿士,參聽棘木之下,然後乃以獄之成疑于王。王三宥之,以聽命而制刑焉。所以重之也。」仲弓曰:「其禁何禁?」孔子曰:「巧言破律,遁名改作,執左道與亂政者,殺;作婬聲,造異服,設伎奇器以蕩上心者,殺;行偽而堅,言詐而辯,學非而博,順非而澤,以惑眾者,殺;假於鬼神時日卜筮以疑眾者,殺。此四誅者,不以聽。」仲弓曰:「其禁盡於此而已?」孔子曰:「此其急者。其餘禁者十有四焉。命服命車不粥於市;珪璋璧琮不粥於市;宗廟之器不粥於市;兵軍旍旗不粥於市;犧牲秬鬯不粥於市;戎器兵甲不粥於市;用器不中度,不粥於市;布帛精麤不中數,廣狹不中量,不粥於市;姦色亂正色,不粥於市;文錦珠玉之器,雕飾靡麗,不粥於市;衣服飲食不粥於市;果食不時,不粥於市;五木不中伐,不粥於市;鳥獸魚鱉不中殺,不粥於市。凡執此禁以齊眾者,不赦過也。」

仲弓曰:古之聽訟,可得聞乎。孔子曰:凡聽五刑之訟,必原父子之親,立君臣之義,以權之,意論輕重之序,慎測淺深之量,以别之,悉其聰明,致其忠愛,以盡之,大司寇正刑明辟以察獄,獄必三訊焉。一曰訊羣臣,二曰訊羣吏,三曰訊萬民也。有指無簡則不聽,簡,誠也。有其意,無其誠者,不論以為罪。附從輕,赦從重,附人之罪,以輕為比,赦人之罪,以重為比。疑獄則泛,與衆共之,衆疑,赦之,故爵人必於朝,與衆共之也。刑人必於市,與衆弃之也。古者公家不畜刑人,大夫不養也。士遇之塗,弗與之言也。屏諸四方,唯其所之,弗及以政,弗欲生之故也。

凡聽訟决獄,必原父子之親,立君臣之義,權輕重之叙,測淺深之量,悉其聰明,致其忠愛,然後察之,疑則與衆共之,衆疑則從輕者,所以重之也。非為法不具也。以為法不獨立,當須賢明共聽斷之也。故舜命皋繇曰:汝作士,惟刑之恤,又復加之以三誶,衆所謂善,然後斷之,是以為法參之人情也。故春秋傳曰:小大之獄,雖不能察,必以情,而世俗拘愚苛刻之吏,以為情也者,取貨賂者也。立愛憎者也。祐親戚者也。陷怨讎者也。何世俗小吏之情與夫古人之懸遠乎。無乃風化使之然邪,有司以此情疑之羣吏,人主以此情疑之有司,是君臣上下不通相疑也。不通相疑,欲其盡忠立節、亦難矣。苟非忠節,免而無耻,免而無耻,以民安所厝其手足乎。

《唐書》曰:長慶中刑部員外郎孫革奏準:「京兆府云陽縣力人張蒞,欠羽林官騎康憲錢米。憲征之,蒞乘醉拉憲,氣息將絕。憲男買德,年十四,將救其父。以蒞角力人,不敢捴解,遂持木鍤擊蒞之首見血,後三日致死者。準律文:」為人所毆,人往救,擊其人折傷,減凡斗三等,致死,依常律。「即買德救父難,是性孝,非暴;擊張蒞是心切非凶。以髫丱之歲,正父子之親,若非聖化所加,童子安能及此?《王制》稱:五刑之理,必原父子之親以權之,測淺深之量以別之。《春秋》之義,原心定罪。周書所訓,諸罰有權。今買德生被皇風,幼符至孝,哀矜之宥,伏在聖慈。職當讞刑,合分善惡。先具事由陳奏,伏冀賜下中書門下商量。」敕旨:「康買德尚在童年,得知子道,雖殺人當死,而為父可哀。若從沉命之科,是失原情之義,宜付法司,減死罪一等處分。」

《禮》曰:分爭辯訟,非禮不決。
又曰:司寇正刑明辟,以聽獄訟,司寇,秋官卿,掌刑者。辟,罪也。必三刺以求民情,斷其獄訟之中。一曰訊群臣,二曰訊群吏,三曰訊萬民。有旨,無簡不聽,簡,誠也。有其意無其誠者不論以為罪。附從輕,附,施刑也。求出之使從輕。赦從重。雖是罪可重,猶赦之。凡聽五刑之訟,必厚父子之親,立君臣之義以權之;權,平也。意論輕重之序,慎測淺深之量以別之;意,思念也。淺深,謂俱有罪本心有善惡。悉其聰明,致其忠愛,以盡之。盡其情也。
