傳曰:魯有父子訟者、康子欲殺。孔子曰:「未可殺也。夫民父子訟之為不義久矣,是則上失其道,上有道,是人亡矣。」訟者聞之,請無訟。康子曰:「治民以孝,殺一不義,以僇不孝,不亦可乎?」孔子曰:「否。不教而聽其獄,殺不辜也;三軍大敗,不可誅也;獄讞不治,不可刑也。上陳之教,而先服之,則百姓從風矣;邪行不從,然後俟之以刑,則民知罪矣。夫一仞之墻,民不能踰,百仞之山,童子登遊焉,凌遲故也。今其仁義之陵遲久矣,能謂民無踰乎?《』昔之君子道其百姓不使迷,是以威厲而刑措不用也。故形其仁義,謹其教道,使民目晰焉而見之,使民耳晰焉而聞之,使民心晰焉而知之,則道不迷,而民志不惑矣。《》曰:『示我顯德行。』故道義不易,民不由也;禮樂不明,民不見也。《》曰:『周道如砥,其直如矢。』言其易也。『君子所履,小人所視。』言其明也。『睠言顧之,潸焉出涕。』哀其不聞禮教而就刑誅也。夫散其本教,而施之刑辟,猶決其牢,而發以毒矢也,不亦哀乎!故曰:未可殺也。昔者、先王使民以禮,譬之如御也,刑者,鞭策也,今猶無轡銜而鞭策以御也,欲馬之進,則策其後,欲馬之退,則策其前,御者以勞,而馬亦多傷矣。今猶此也,上憂勞而民多罹刑。《》曰:『人而無禮,胡不遄死!』為上無禮,則不免乎患;為下無禮,則不免乎刑;上下無禮,胡不遄死!」康子避席再拜曰:「僕雖不敏,請承此語矣。」孔子退朝,門人子路難曰:「父子訟、道邪?」孔子曰:「非也。」子路曰:「然則夫子胡為君子而免之也?」孔子曰:「不戒責成,害也,慢令致期,暴也,不教而誅、賊也。君子為政,避此三者。且《》曰:『載色載笑,匪怒伊教。』」
