象刑說         程大昌舜典曰象以典刑臯陶曰方施象刑惟眀是唐虞固有象刑矣而去古既遠說者不一荀況記時人之語曰象刑墨黥慅嬰共艾畢菲對屨殺赭衣而不純也漢文帝詔除肉刑曰有虞氏畫衣冠異章服以為戮而民不犯今法有肉刑三而姦不止武帝之策賢良也亦然白虎通曰畫象者其衣服象五刑也犯墨者●巾犯劓者以赭著其衣犯髕者以墨●其髕象而劃之犯宮者●犯大辟者布衣無領凡此數說者雖不能歸於一要其大致皆謂別異衣服以愧辱之而不至於用刑此遠古而譌傳也禹之稱舜曰與其殺不辜寧失不經特不殺不辜爾未嘗去殺也怙終賊刑刑故無小是豈嘗置刑不用哉戰國之時未經秦火已謂象刑者示辱而已無所事於刀鋸斧鉞也荀況既知其不然而亦不能別援古典以審其有無特能推理以辯而曰以為治邪則人固莫觸罪非獨不用肉刑亦不用象刑矣人或觸罪矣而直輕其刑是殺人者不死傷人者不刑也此數語者雖堯舜復出無以易也●雄曰唐虞象刑惟眀夏后肉辟三千不膠者卓矣雄以肉辟始夏則真謂堯舜之刑無刀鋸斧鉞矣此盖漢世之所通傳故文武二帝詔語亦以為然也肉刑之制孔頴達軰集㑹傳記皆不能知其所起然而劓刖㧻黥苗民固己有之帝舜斥數其虐特以不能差罪而遂至於淫用爾則肉辟所起豈復待夏后氏之世哉且舜之刑五服五用眀有所施而此時未有笞杖徒若無肉刑其閱罪而五服之法服罪而五用之刑以何器具而行其論決哉況象刑之次每降愈下方有流鞭扑撻若謂象刑止於示辱則是正麗五刑者反可以異服當刑而惡未入刑者乃真加之流鞭扑撻焉是何其不倫也然則象刑云者是必模寫用刑物象以眀示民使知愧畏而何他求泛說哉第世言象刑者不究其本而直謂畫象可以代刑則人不信爾夫子之言曰不教而殺謂之虐莊周曰匿為物而愚不識皆咎世之敎飭無素者也蓋周人布刑象之法大司寇垂之象魏小司寇宣之四方則既詳矣猶以為未也則有執木鐸以警者執旌節以逹者屬民而讀者書五禁于門閭者諭刑罪于邦國者其上下相承極其重複正慮不知者之誤觸也以此言之則藉藻色以暴昭其可愧可畏者正聖人忠厚之意也世之有魑魅魍魎人固不願與之相值也然天地間不能無此聖人範金肖物著諸鼎以示之則山行草者知畏而預為之避也此其鑄鼎象物之意與畫象而期不犯之意同也夫謂衣冠之為象刑固不足以得其實矣而亦不無所本也司圜掌收敎罷民凡害人者弗使冠飾而加眀刑焉鄭元因有弗使冠飾之文而遂用以證實其語曰不冠而著墨幪若古之象刑也夫象以典刑揆諸舜典則在流贖之先而加桎梏去冠飾質之司冦顧在五刑糾慝之外設使其制誠嘗輔刑以行則不過若畢命之殊異井疆也秦人之赭衣徒●也漢世之胥靡旦舂也本非正在用刑之數則安可以刑餘之輕者而證古制大典也哉且夫舜命臯陶作士而授以制刑之則類皆差五刑而三其服即五服而三其就凡所以測淺深綦嚴宻無不曲盡而槩謂示耻可以去殺固無惑乎後世之不信也於是結繩理暴秦之緒干戚解平城之圍遂為迂左者之口實抑不思有太古之民則結繩雖簡豈不足以立信有舜禹之德則干戚非武亦豈有不能屈服強梗之理哉是畫象者可以昭愧畏而非以致其愧畏也欲知畫象之為刑助其必循本以觀乃有得哉
