3  | 二年六月十二日，大理少卿王爵奏：「伏准貞觀五年八月二十一日敕：『極刑雖令即决，仍三覆奏，在京五覆奏，决前三奏，决日兩奏。准犯惡逆者一覆奏。著於格令。』又准建中三年十一月十四日敕：『應决大辟罪，在京者宜令行决之司三覆奏，决前兩奏，决日一奏。』謹按斷獄，諸死罪囚不待覆奏報下而决者，流二千里；即奏報應決者，聽三日乃行刑，若限未滿而行刑者徒一年。伏以人命至重，死不再生，近年以來，全不覆奏，或蒙赦宥，已被誅夷，伏乞敕下所司，應在京有犯極刑者，令决前、决日各一覆奏，聽進止。有凶逆犯軍令者，亦許臨時一覆奏。應諸州府乞別降敕命指揮。」奉敕：「宜依。」 |
