5  | 元祐元年春正月庚寅朔，改元。辛夘，詔廣西經略司體量、知廣源州楊景通遣覃安等劫虜邊民，仍移牒安靜海軍，問不遵詔敕端由。壬辰，詔曰：「乆時雪慮囚繋，淹留在京，委刑部郎中、御史、開封府界令提㸃司諸路州軍，令監司催促結絶」。先是，上封者言：「竊惟時雪未應，隂陽不和，意者刑獄未至欽恤，法令未至寛平，官吏未至恪職，文符多所滯留，上下偷安，以茍目前，《洪範》曰：肅時雨若，此其上下不肅之所致歟？朝廷任事之臣，不同心憂，國人懐私意，有所詆欺歟？下者六曹尚書、侍郎，不以其身許國，而郎中、貟外，雖不材，不勝其任，與不悉心職事者，不為朝廷別白才否而去留之，郎中、貟外胥吏不任事，稽違懈弛，不加繩治，一切寛假，浸以成風，自尚書省左右僕射、左右丞領之，其獘且爾，況百司乎？臣愚以謂冝下詔恤天下刑獄，命從官分治在京獄事，蠲除法令，與祖宗朝異意者，飭尚書省，在京百司，務恪其職，使皆以身任責，有不如㫖，御史諫官以次條陳其失，朝廷按而行之，不赦，如此則隂陽和，天地應，雪以時降，氣序和平矣」。乙未，詔前入內東頭供奉官、配汝州牢城韓永式，特放從便。永式嘗為經制瀘州夷賊司照管軍馬公事，及韓存寳逗撓不進，殺平人効級被誅，永式以罪連坐，特配沙門島，三徙汝州牢城。至是，其母復引赦乞原放，特從之。 |
