40  | 冬十月戊子，始行新律。詔曰：「夫絞以致斃，斬則殊形，夫，音扶。除惡之體，於斯已極。梟首、轘身，義無所取，不益懲肅之理，徒表安忍之懷。忍，殘忍也。安忍，安于為殘忍之事。鞭之為用，殘剝膚體，徹骨侵肌，徹，敕列翻。酷均臠切。雖云往古之式，《舜典》曰：鞭作官刑。故云往古之式。事乖仁者之刑。梟、轘及鞭，並令去之。貴帶礪之書，不當徒罰；令，力丁翻，使也。去，羌呂翻。漢高帝分封功臣，與之剖符作誓曰：「使黃河如帶，泰山若礪，國以永存，爰及苗裔。」廣軒冕之蔭，旁及諸親。服冕乘軒，貴仕也。流役六年，改為五載；載，作亥翻。刑徒五歲，變從三祀。祀，亦年也。其餘以輕代重，化死為生，條目甚多，備於簡策。雜格、嚴科，並宜除削。」自是法制遂定，後世多遵用之。宋朝所行之《刑統》，舊所傳者也。 |
