66  | 俞焜，字昆上，浙江钱塘人。嘉庆二十五年进士，改庶吉士，授编修。道光十三年，迁御史，奏请申明律义，以正伦纪，略言：「律载『弟妹殴同胞兄姊死者皆斩』。注云：『殴死期亲尊长，若分首从，则伦常斁矣。』此古今定律，所以维名教也。其听从尊长，殴死以次期亲尊长之犯，向律拟斩，定案时夹签声请，叠经改为斩监候，归入服制情实。自道光三年御史万方雍奏，将听从尊长，殴死以次期亲尊长，下手伤轻之卑幼，均科伤罪。刑部定为条例，至今沿之。因思例从律出，例因时变通，律一成不易。致死尊长，岂得仍论伤之重轻？今以勉从尊长，下手伤轻，止科伤罪，则与『死者皆斩』之律未符。此例既百无一抵，何以肃典刑而正人心？请仍遵不分首从本律，夹签声请，以昭平允。」下部议行。 |
